The following will provide insight into the status of the Eminent Domain issue nationwide.  Those who lost their homes in New London, CT to Eminent Domain have been victimized twice.  First, by the government to include the Supreme Court, the State of Connecticut, the City of New London, and the New London Development Corporation (NLDC) and its law firm.  Second, and most recently, by Tom Condon, a columnist for the Hartford Courant who is also the brother of the attorney for the NLDC who helped to drive Suzette Kelo and her neighbors from their homes.

While the State Legislature fails to act to protect the property rights of Connecticut homeowners and businesses, those who are so gallantly fighting to protect our property rights must filter through the conflicts when reading columns such as the one which follows.   The column was written by Tom Condon, a paid columnist employed by the Hartford Courant.  He offers his opinion on the eminent domain issue in New London.  The following is an excerpt  In retrospect, it was a local matter opportunistically and brilliantly exploited by the property rights movement. This coalition of miners, oil drillers, ranchers, the motorized recreation industry, Libertarian groups such as Americans for Limited Government and others, who've been fighting environmental and land-use regulations for two decades, turned this into a national hysteria.”   Mr. Condon’s words such as “opportunistically”, “exploited” and “hysteria” are an insult to Suzette Kelo and her neighbors who so bravely fought to keep their homes only to ultimately lose them to powers far greater than their efforts.    Their cause was championed by the Institute of Justice http://www.ij.org/search/search.asp  which dedicated their time and resources to defending the rights of Suzette Kelo and her neighbors.   The Institute of Justice continues to champion the property rights of Americans throughout this country, with their most recent success realized in Florida.  Victory Against Eminent Domain Abuse

Redevelopment is the precursor to Eminent domain.  It’s big business.  It lines the pockets of developers, lobbyists, attorneys, consultants, and those special interests aligned with government officials who pass laws which undermine our rights.   Elected public officials yield their responsibilities to quasi-public agencies such as the New London Development Corporation, which have limited accountability to the public and which are financed by our tax dollars.  This “local matter” as Tom Condon describes it captured the spotlight of the nation due to the Supreme Court ruling which left all property owners in this country vulnerable to the influence of private developers on government officials and agencies.   The “hysteria” surrounding this issue is warranted.  Hysteria gives way to fear when homeowners under the threat of  Eminent Domain realize they are powerless when they do not have the financial resources to fight those  who are financed with taxpayer dollars to take their homes, such as Attorney David Condon, the brother of Tom Condon.   

 

Suzette Kelo and her neighbors who fought to keep their homes will be remembered for years to come as gallant crusaders for property rights throughout this nation.  Ms. Kelo has earned her place in history as the patriot of our time.   The Institute of Justice and property rights activists nationally will continue to gain the support of State legislators throughout this country who are willing to reform Eminent Domain laws to protect their constituents.   And Tom Condon’s brother?  Well, he will simply be remembered as someone who made his money driving honest, hardworking Americans from their homes!  Susan Kniep

Kelo's Legacy: A Win For Property Rights Movement

Byron Athenian, the last homeowner remaining in the Fort Trumbull neighborhood in New London, has bought a new home and moved. Susette Kelo, perhaps the best known displaced homeowner in the neighborhood, has until June 15 to move her pink house to another site, and reportedly has a site in mind. After nearly a decade of planning and tumult, and two years after the Kelo v. New London decision in the U.S. Supreme Court, redevelopment of the small peninsula along the Thames River is about to begin (although residents have heard that before).

So now might be a good time to ask how this all happened, how a tiny, out-of-the-way, working-class neighborhood became a symbol of national outrage, a clarion call against the evils of eminent domain.

 

In retrospect, it was a local matter opportunistically and brilliantly exploited by the property rights movement. This coalition of miners, oil drillers, ranchers, the motorized recreation industry, Libertarian groups such as Americans for Limited Government and others, who've been fighting environmental and land-use regulations for two decades, turned this into a national hysteria.

President Bush issued an executive order limiting federal use of eminent domain. Good old white-bread Parade Magazine ran a cover story titled, "Will Government Take Your Home?" Bills were introduced in Congress and in state legislatures across the land to limit or eliminate eminent domain. Politicians by the boatload bloviated against government intrusion (Remember Domain!). Though they lost in court, the case was the property rights gang's greatest public relations victory.

It shouldn't have happened, and wouldn't have happened if the Fort Trumbull project had been more thoughtfully planned.

To quickly summarize, the Fort Trumbull project stems from two events, the 1996 closing the U.S. Naval Underwater Warfare Center, known locally as the Sound Lab, and the building of the Pfizer Global Research Center on the other end of the peninsula in 1998.

The city originally was going to leave the neighborhood alone and have the Navy sell the Sound Lab to a developer. The city would control the project through zoning. This was approved by the city council. It would have been fine; the neighborhood, which was not blighted, was then showing small signs of improvement (Ms. Kelo bought her house, for example).

But the coming of Pfizer, the city's first major economic development in decades, was too much to leave alone. Civic leaders decided a bigger development would better leverage the Pfizer presence. The mercurial Claire Gaudiani, president of Connecticut College and the nonprofit New London Development Corp., wanted a major development. State officials had a heavy hand in the matter. City officials in the state's second-smallest geographical municipality, always desperate for property tax revenue, had to listen.

Thus came a new plan, for a hotel and conference center, marina, offices and upscale housing on the 90-acre site. It would fit in with a new state park. But it was one of those 1960s renewal-era plans that essentially clear-cut the neighborhood. It required the acquisition of about 115 private properties. Most owners sold; a handful refused. The city moved to seize their properties by eminent domain. The owners sued. The Institute For Justice, which bills itself as the country's only Libertarian public interest law firm, took the case.

The question was whether the proposed taking of the land for private development - to generate jobs and tax revenue - was a "public use" under the "takings clause" of the 5th Amendment. Though it apparently came as a surprise to many, this generally has been the law for decades. A 1954 case on this point gave legal sanction to the postwar urban renewal program (with decidedly mixed results). Legally, the Kelo case was not earth-shattering.

But the property rights movement turned it into a cause celebre. This movement, born in the late 1980s from the far Republican right, argues that management and restriction of private property is un-American, inefficient and ineffective, said University of Wisconsin professor Harvey M. Jacobs, an authority on the movement.

Thus far, 34 states have either tightened or prohibited use of eminent domain, and some have passed other laws limiting government action. More than that, the property movement has "captured the public debate," changed the focus of argument on land use and environmental regulation from how it advances public goals to how it impinges on private property, Jacobs said at a recent seminar at the Lincoln Land Institute in Cambridge, Mass.

But there needs to be a balance between private and communal interests in land, and as Jacobs said, it's a balance we're always renegotiating.

The community side of the equation needs to be heard from, because communities have to be able to plan for their futures. Banning eminent domain is wrong. Eminent domain is a power that government ought to have, but it must be used judiciously, as a last resort (and mostly it is). Perhaps most important, it must be used in the furtherance of good planning.

I grew up in New London; my grandmother lived in Fort Trumbull. If I were putting a new hotel and housing in the city, I'd try to put it about a mile away, in the heart of downtown. At the very least I'd have integrated it into the existing Fort Trumbull neighborhood. The block where Ms. Kelo's house still stands, called Parcel 4A in the documents, will likely be used for marina parking. That is almost criminal. Fort Trumbull could have become a cool little shoreline enclave.

But what's done is done and I hope the new development works, thought I fear it will take years for New London to recoup all the lost taxes and expenses connected with this ill-starred venture. Perhaps what we need is a new way to assemble property, one that avoids eminent domain. There is a process used in Japan, Israel and several European countries called "land readjustment," in which large redevelopment parcels are assembled by giving owners a stake in the new development. If owners can be convinced they'll share in a successful project, there may be fewer holdouts.

This can take time, but then so has the Fort Trumbull plan.
